TERMS OF USE

Satisfaction Guarantee

The Client will notify the Service Provider of any concerns regarding the Services immediately and allow the Service Provider the opportunity for remedy through collaboration. The Service Provider will take reasonable steps to ensure that the Services are delivered in accordance with the Agreement and the Clients reasonable expectations. This guarantee does not change or exclude the Clients or Service Providers rights under the work agreement or under any applicable consumer law guarantees.

The GuardHERE Logo, name and associated branding, website icons and characters, products, posts, examples and downloads are (C) Copyright to GuardHERE Consulting and must not be resold, used or changed without permission from us.

LIMITATION OF LIABILITY

Any tips, advice, information or other content that is published by us on our/other platforms, channels or other methods is of a general nature only and is provided ‘as is’ for general consideration and does not constitute formal/professional advice.

Online Retail Platform

Despite our diligent efforts to maintain the accuracy and currency of our digital storefront, occasional errors (E&OE) may occur due to human oversight, such as pricing discrepancies or stock availability issues.

Kindly note that the submission of an order through our website does not constitute a binding agreement until we have processed and confirmed your order. In the event of an error affecting your order, like a pricing or stock discrepancy, we reserve the right to refrain from fulfilling the order. However, we will promptly reach out to you to discuss available options, including placing the order at the correct price, delaying delivery, or facilitating an exchange. Should we be unable to fulfil your order, a full refund will be processed without undue delay.

Payment Terms

By purchasing on our website, you agree to remit the listed purchase price as displayed. We retain the right to adjust prices periodically, with notice provided by updating the prices on our platform.

Your full and timely payment is a fundamental condition of this agreement. Failure to fulfil this condition entitles us to terminate the agreement immediately. Any costs incurred by us due to returned or denied payments, including banking fees, shall be your responsibility. Furthermore, we reserve the right to suspend delivery of unpaid orders or to terminate the agreement in case of non-payment.

Accepted payment methods currently include credit and debit cards (Visa, Mastercard, American Express), digital wallets (Apply Pay, Google Pay) and gift cards issued by us. 

By initiating a payment, you confirm your acceptance of the terms stipulated both by us and also third-party payment gateways or credit providers, such as PayPal, Square or digital wallets, available on their respective platforms. These services are provided for your convenience, and any issues arising from their use should be addressed directly with the third-party provider.

Promotional Offers and Voucher Codes

Periodically, we may extend discounts or issue coupon codes.

Please note that these discounts or coupon codes cannot be combined with any other offers. They are valid for online purchases through the shop only,  for the specified duration and apply only to full-priced items unless stated otherwise. Coupon codes are non-transferable and hold no cash value. We retain the right to revoke any discount or coupon offer without prior notice.

Digital Product Access

All our e-commerce shop products are digitally delivered. Upon a valid purchase, you will receive an email containing a direct download link. Additionally, a download link will be provided on the order confirmation page for immediate access. Should you encounter any download issues, please contact us via our contacts page on the main website.

(a) Processing Time: Orders are processed automatically upon receipt of payment. Please allow up to one hour for the delivery of your order confirmation email. Delays may occur during periods of high order volume, for which we appreciate your patience. Please ensure to check your junk folder as well.

(b) Email Accuracy: It is your responsibility to ensure the accuracy of your email address. We shall not be held liable for any failed deliveries resulting from inaccurate email information provided by you.

(c) Risk: Risk associated with each order transfers to you upon delivery to your designated email address.

Unforeseen Circumstances

In instances beyond our control, such as strikes, natural disasters, or technological disruptions, we may encounter challenges in fulfilling orders. During such circumstances, we reserve the right to postpone order dispatch or cancel orders. We commit to contacting affected customers promptly to explore suitable resolutions.

Disclaimer

By purchasing, downloading, using and customising our templates, you acknowledge that no consultant-client relationship is established, and no legal, service or security advice is provided by us.

Our templates are provided to you on an ‘as is’ basis in the format and document type at the time of download. GuardHERE Consulting does not guarantee compatibility with older versions of Microsoft Office or any other software used to open this document nor that this document is correct for your individual needs, and recommends that you seek independent advice if required, as well as reading through the entirety of the document to check your needs.

If you choose editing assistance during checkout, we will contact you directly regarding this process. The same terms as listed herein apply, and additional terms may also apply (such as timeframes and expected outcomes) which will be agreed upon in writing prior to editing assistance commencing. Also, unless specifically requested not to, we reserve the right to add the Client to the newsletter subscription service and refer to the Clients business name to indicate services have been provided by the Service Provider to the Client. We may also show the Clients company logo on our website and other marketing materials.

We may provide advice or information regarding our products in good faith, but we do not warrant its accuracy or reliability. Such information is general and should not substitute professional advice. We disclaim liability for any losses incurred due to reliance on our website or product information, or advice, except where mandated by law.

All products are granted on an individual licence. That is, you have the right to use the document however you wish for your individual or business needs, however you are not given permission to resell or redistribute our products as your own work.

Supplementary information may be included with your purchase or download, such as editing notes and tips, and limitations of the templates, all of which form part of your purchase agreement.

Consumer Rights

Our products come with guarantees under the Australian Consumer Law, ensuring replacement, refund, or compensation for product defects. These rights remain unaffected by these terms. We exclude all other warranties to the extent permitted by law and limit liability for breaches to specified remedies, in line with these terms.

Refund Procedure

As products are digital and available for immediate download upon purchase, we do not specifically offer refunds. If unsatisfied, please contact us within 30 days of purchase to discuss your concerns. We aim to address and resolve issues promptly. Intellectual Property Rights

All copyright in our documents is owned by GuardHERE Consulting. You are granted a limited license to use our documents within the disclosed business context. Unauthorised use for commercial gain or competition with our business is prohibited. Intellectual property rights remain our sole property.

Amendments

We reserve the right to update these terms, with changes taking immediate effect upon posting on our website.

Severability Provision

If any part of these terms is deemed invalid, the remainder shall remain enforceable.

Termination PROVISION

We may terminate this agreement at our discretion, with disclaimers and liability limitations surviving termination. Refunds will be issued for undelivered goods upon termination notice.

Jurisdiction

These terms are governed by the law in the state of Victoria. Disputes will be resolved in Victorian courts, with mediation as the initial step towards resolution.

GuardHERE Consulting will not charge any fee for your access request but may charge an administrative fee for providing a copy of your Personal Information.

In order to protect your Personal Information, we may require identification from you before releasing the requested information.

It is important to us that your Personal Information is up to date. We will take reasonable steps to make sure that your Personal Information is accurate, complete and up-to-date. What personal data we collect and why we collect it

Comments

When visitors leave comments on the site, we collect the data shown in the comments form, and the visitor’s IP address and browser user agent string to help spam detection.

Our website may use third party applications for the purposes of comments, user interactions, profiles, etc. and they may operate additional privacy policies.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included.

Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you have an account and you log in to this site, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognise and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.
